This Website is operated by Just Talk Ltd (“TalkingTherapy” or “We”) registered in England and Wales under company number 13415732 at 16 Rutland Park Gardens, London, NW2 4RG. We may revise and update these Terms and Conditions at any time. Your continued usage of the TalkingTherapy.Space Website (or the “Website”) means you accept those changes.

1.      Lawful use of our Website

1.1. Access to our Website is free of charge but online sessions with self-employed counsellors and psychotherapists (also referred to in these terms as ‘Practitioners’), that you book directly with them through our Website, are charged for by those Practitioners directly.

1.2. We do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. Access to our Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Website and content. We will not be liable to you if for any reason our Website is unavailable at any time

1.3. This Website is intended for residents in the United Kingdom. Just Talk Ltd makes no claims that Just Talk Ltd is appropriate or may be accessed from outside of the United Kingdom. Access to the information on the Website, or booking specialists through the Website, may not be legal by certain persons or in certain countries. If you access the Website from outside the United Kingdom, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

1.4. Use of this Website does not create an expressed or implied counsellor-client or psychotherapist-client relationship with Just Talk Ltd: by booking a session with one of our self-employed Practitioners, you enter into the contract with them

1.5. You may not use our Website

i.     In any way that breaches any applicable local, national or international law or regulation.

ii.     In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

iii.     For the purpose of harming or attempting to harm any person in any way.

iv.     To bully, insult, intimidate or humiliate any person.

2.      Who provides the service

2.1.   The service is provided by Practitioners – psychotherapists and counsellors. We operate the Website and we are not the providers of these services; the service provider shall at all times be the Practitioner. All of the Practitioners are self-employed and are regulated by their respective regulatory bodies. Each Practitioner has their own set of terms and conditions, and any therapeutic contract will be formed between you and your chosen Practitioner.

2.2. We do not take payment. Your contract with Practitioner will include cancellation policy and the payment terms

2.3. The psychotherapists and counsellors are regulated by some or all of the professional bodies below:

i.     UK Council for Psychotherapy (UKCP)

ii.     British Association of Counselling and Psychotherapy (BACP)

3.      The Website is for informational purposes only:

3.1. You must not rely on the information on our Website. You must obtain professional or specialist advice before undertaking or not undertaking any action on the basis of the content on our Website

3.2. This Website does not provide any medical or mental health advice; all our content is for general health information only

3.3. TalkingTherapy.Space makes no warranties nor expresses or implies representations whatsoever regarding the accuracy, completeness, timeliness, comparative or controversial nature of, or usefulness of any information contained or referenced on this Website. TalkingTherapy.Space does not assume any risk whatsoever for your use of this Website or the information contained herein. Health-related information changes frequently and information contained on this Website may be outdated, incomplete or incorrect.

3.4. This Website is not to be used as a substitute for medical advice, diagnosis or treatment of any health condition or problem, including, mental health conditions. You should not rely on the information provided on this Website for your health problems. Any questions regarding your health should be addressed to your GP or other healthcare providers.

Just Talk Ltd, its licensors, advisors and suppliers to the fullest extent permitted by law disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties’ rights and fitness for particular purpose

4.3. Without limiting the foregoing, Just Talk Ltd, its licensors, its advisors and its suppliers make no representations or warranties about the following:

i.     The accuracy, reliability, completeness, accuracy, or timeliness of the information, software, text, graphics, links, or communications provided on or through the use of the Website

ii.     In no event shall Just Talk Ltd, its advisors, its licensors, its suppliers, or any third parties mentioned on the Website be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the Website, whether based on warranty, contract, tort, or any other legal theory, and whether or not Just Talk Ltd, its licensors, its advisors, its suppliers, or any third parties mentioned on the Website are advised of the possibility of such damages.

iii.     Just Talk Ltd, its licensors, its suppliers, or any third parties mentioned on the Website shall be liable only to the extent of actual damages incurred by you, not to exceed £1000. Just Talk Ltd, its licensors, its suppliers, or any third parties mentioned on the Website are not liable for any personal injury, including death, caused by your use or misuse of the Website.

iv.     We provide the booking and administrative services only. We will not accept liability for any loss or damage resulting from contact with or services provided by the Practitioners. Any complaint against a Practitioner should be raised with the Practitioner in the first instance and, if necessary, escalated to their respective member organisation.

v.     Where our Website contains links to other sites and resources provided by third parties, these links are provided for your information only. Links to the information on other Websites should not be interpreted as approved of or endorsed by us. We will not be liable for any loss or damage that may arise from your use of them.

iv.        When using the Website, information will be transmitted over a medium that may be beyond the control and jurisdiction of Just Talk Ltd and its suppliers. Accordingly, Just Talk Ltd assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with the use of the Website.

v.          We are not liable for business losses. We only supply the services and digital content for domestic and private use. If you use the services and digital content for any commercial, business, or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

5.      Indemnity

5.1.      You agree to defend, indemnify, and hold Just Talk Ltd, its officers, advisors, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities, and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.

6.      Use of Materials

6.1. All materials posted on this Website are protected by the copyright laws in the United Kingdom and in other countries.  You may not download or otherwise copy any material found on the Website.

6.2. Any use of the materials not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws. Content and features are subject to change or termination without notice in the editorial discretion of Just Talk Ltd.

6.3. Our Website contains materials owned by or licensed to us. These materials include, but are not limited to, the design, appearance and graphics. Reproduction is prohibited.

7.      Passwords

7.1. Just Talk Ltd has several tools that allow you to record and store information. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your Just Talk Ltd passwords or accounts. It is your sole responsibility to (1) control the dissemination and use of sign-in name, screen name and passwords; (2) authorize, monitor, and control access to and use of your Just Talk Ltd account and password; (3) promptly inform Just Talk Ltd if you believe your account or password has been compromised or if there is any other reason you need to deactivate a password. To send us an email, use the “Contact Us” links located at the bottom of every page of our site. You grant Just Talk Ltd and all other persons or entities involved in the operation of the Site the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Site. i. You expressly agree that exclusive jurisdiction for any dispute with Just Talk Ltd, including without limitation relating to or arising from use of the Website, resides exclusively in the courts of England & Wales.

9.4. These Terms and Conditions are governed by the laws of England and Wales

9.5. Except as expressly provided in a particular “legal notice” on the Website, these Terms and Conditions, the Disclaimer and the Just Talk Ltd Privacy Policy constitute the entire agreement between you and Just Talk Ltd with respect to the use of the Website.

9.6. Any dispute relating to or arising from these Terms & Conditions or use of the Website shall be governed by the laws of England and Wales and the courts of England & Wales shall exclusive jurisdiction to settle any such dispute.
